Mentally Retarded Teen Gets 100 Years


Mentally Disabled Youth with IQ Of 47, Allowed to Plead Guilty to Sexual Assault of a Child, Judge Orders Sentences to be Served Consecutively

The jury said it did not like the sentencing options made available to it. The judge said he was not pleased that he had to sentence an 18-year-old Paris, Texas teenager to 100 years in prison. The district attorney said he “sympathized” with teenager’s situation but it had to be remembered that he “committed a violent sexual crime against a little boy.”

What exactly did Aaron Hart do? A neighbor said she discovered the mentally retarded teenager, who has an IQ of 47, fondling her stepson last November. Hart was arrested and charged with five counts of aggravated sexual assault of a child and indecency with a child.

Hart’s attorney allowed the mentally disabled youth to plead guilty at the punishment phase of his trial but elected to have the jury assess punishment at the penalty phase. After hearing all the evidence, jurors were not convinced that prison was the best option for Hart. They sent notes to the judge requesting guidance on possible alternatives to imprisonment. Jurors told the media following the trial that the judge’s responses did not provide them with any “clear answers.” They assumed the judge would impose concurrent sentences on the five convictions.

But that is not what the judge did. He sentenced Hart to 5-year terms on two counts and 30-year terms on three counts. The judge ordered the sentences to be served consecutively for a total of 100 years. Lamar Count Judge Eric Clifford’s offered the lame excuse that he didn’t believe he had any other sentencing options because “in the state of Texas, there isn’t a whole lot you can do with people like him.”

This case begs appellate intervention. Media reports did not explain why his attorney allowed him to plead guilty at the guilt phase. The guilty plea itself raises serious questions. Hart never learned how to read or write and has had a 47 IQ since he was a child. “He couldn’t understand the seriousness of what he did,” Aaron’s father Robert told the Dallas Morning News. “I never dreamed they would think about sending him to prison. When they said 100 years—it was terror, pure terror, to me.”

What does the law say?

The Texas Court of Criminal appeals has defined mental retardation as a disability characterized by: 1) “significantly subaverage” general intellectu8al functioning; 2) accompanied by “related” limitations in adaptive functioning; 3) the onset of which occurs prior to the age 16. 1/

With a 47 IQ, young Aaron Hart certainly fell within this definition of mental retardation. While Texas law presumes that a criminal defendant is mentally competent to stand trial unless incompetence is proven by a preponderance of the evidence, Article 46B.003(b) of the Texas Code of Criminal Procedure, state law also prohibits a trial court from accepting a guilty plea unless it appears the defendant is mentally competent, Article 26.13(b) of the Code of Criminal Procedure.

Article 46B.003 of the Code of Criminal Procedure states that a criminal defendant is incompetent to stand trial if he/she lacks the ability to confer with his/her attorney with a reasonable degree of rational understanding of the proceedings being taken against him/her. And Article 46B.004(c) of the Code of Criminal Procedure provides that if any evidence comes to the attention of the trial court suggesting incompetence, the judge must determine by informal inquiry whether there is “some evidence” from any source that would suggest the defendant is incompetent to stand trial.

The judge in Hart’s case certainly had some evidence of incompetency with Hart’s 47 IQ. This was made clear by the Texas Court of Criminal Appeals when it held that evidence of incompetency is usually sufficient if it shows “recent severe mental illness, at least moderate mental retardation, or truly bizarre acts by the defendant.” 2/

Aaron Hart was more than moderately retarded. He was severely retarded. There is no plausible justification for a trial court accepting a guilty plea at the punishment phase by an 18-year-old illiterate teenager with a 47 IQ. The very purpose of these state laws, which were enacted to protect mentally disabled and incompetent individuals from being abused by the legal system, were undermined by the trial judge’s acceptance of Hart’s guilty plea.

For more than three decades, the Texas Court of Criminal Appeals has held that a defendant’s mental impairment is a major factor to be considered in determining whether he/she is capable of understanding the relinquishment of any constitutional right. 3/ With this precedent so clearly established, it is difficult to understand, first, why Hart’s attorney elected to waive his client’s constitutional right to have his guilt decided by a jury, and, second, why the court without apparent question accepted the guilty plea at the punishment stage.

Clearly, young Hart had a possible defense of incompetency based on severe mental retardation. The State of Texas had the burden to prove beyond a reasonable doubt that the mentally challenged young man could form the necessary requisite intent to commit the crimes he was charged with. The jury had serious reservations about the case based in the limited evidence it heard during the punishment phase. Had jurors heard Hart testify in his own behalf, listened to the victim’s testimony, and weighed expert testimony on the issue of mental retardation, it is more than like they would have found him not guilty because he was unable to form the requisite intent the crimes demanded. The jurors specifically stated they wanted alternatives to imprisonment. A trial on the evidence would have given them clear alternatives—not guilty verdict, or a guilty verdict to lesser charges.

Once again the Texas criminal justice system had been held out to national and international criticism. The State already leads the nation with the most DNA exonerations, the most executions in America, one of the most abusive juvenile incarceration systems in the country, a score of recently convicted sheriffs and district attorneys sent off to prison, a host of questionable shooting deaths and beating deaths by the police, and laundry list of other corrupt practices by those charged with administering “justice” in the state.

We can only hope that either a court of appeals or the Court of Criminal Appeals will vacate Aaron Hart’s conviction and remand the case for a new trial. We also pray that the young man will not be abused in the state’s overcrowded and violent prison system while his case works its way through the appeal process.

There are some landlords out there who feel that they can enter upon property they have rented to another without taking any steps to alert the renter or seek the renterˆÇ¬í's permission. Even before enactment of Ohio's Landlord Tenant Act of 1974, this was a fallacious belief.

At common law, when the owner of real property signed a lease agreement to rent it out to another, he gave up, via the lease agreement, his right to possession of that property. The owner still retained ownership, but one of the important rights of ownership, the right to possession, was signed away. Some leases did allow the owners a limited right of access, but if such a thing was not in the lease agreement, the owner could get into trouble for going on to his own land. That kind of trouble came from the common law action of trespass. Since trespass is an intentional tort, a court's finding that the owner trespassed upon the rented property subjected the owner to civil liability for actual damages, attorneys fees, and even punitive damages. Further, the owner could face criminal charges as well.

In 1974, Ohio passed the Landlord Tenant Act of 1974. Part of that Act, Ohio Revised Code Section 5321.04 describes the landlord's duties to the tenant in any rental relationship. Specifically, R.C. 5321.04(A)(8) states that the landlord must: "Except in the case of emergency or if it is impracticable to do so, give the tenant reasonable notice of his intent to enter and enter only at reasonable times. Twenty-four hours is presumed to be a reasonable notice in the absence of evidence to the contrary."

The law also imposes upon the tenant a duty to be reasonable in granting access to the landlord when the landlord makes a request to enter. Ohio Revised Code 5321.05 states that: The tenant shall not unreasonably withhold consent for the landlord to enter into the dwelling unit in order to inspect the premises, make ordinary, necessary, or agreed repairs, decorations, alterations, or improvements, deliver parcels that are too large for the tenant's mail facilities, supply necessary or agreed services, or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workmen, or contractors.

t is clear then that under the statute, the landlord must give reasonable notice to the tenant of his intent to enter, and work with the tenant concerning setting up a mutually acceptable time. The tenant is required to work with the landlord to assure that the landlord can access the premises. A violation of either's duty to the other in this regard is a violation of the law.

It is important to note that while the statute mentions 24 hours as being presumed to be reasonable notice, it is a presumption only. A legal presumption is one of those rare instances where the court is entitled by law to start of with a predisposition about a case. In this example, the court will start off with the thought in its head that 24 hours notice is sufficient notice to the tenant. But the tenant is entitled to bring in evidence to rebut this presumption.

Here's an example of how 24 hours notice might not be sufficient. The tenant is a firefighter, and he works a shift which is 48 hours on and the rest of the week off. The tenant has informed the landlord about this and the landlord knows that the tenant works from Monday morning at 7:00 a.m. until Wednesday morning at 7:00 a.m. The landlord wants to inspect the rented premises and on Monday at noon places a note on the door informing the tenant that they wish to come in on Tuesday at 4:00 p.m. to inspect.

The tenant will never get this note in time, and will be unaware of the landlord's plans. If the matter ever goes to court, the landlord will argue that he gave more than 24 hours notice of his intent to enter, and the tenant will argue that because of his schedule (which the landlord knew about), the notice was insufficient.

Who the court will determine is right and wrong in this matter is less important than the fact that the landlord is now in the middle of a court case and is bleeding attorney fees when it all could have been prevented by knowing what the law is and how to remain on the side of compliance with it.

Further, it should be well understood by landlords that Ohio Revised Code Section 5321.04(A)(8) does not replace the common law structure referred to above, but rather supplements it. This means that in addition to suing the landlord for violation of Ohio Revised Code Section 5321.04(A)(8), the tenant can also sue upon the common law action of trespass (with its possibility of recovery of punitive damages and attorneys fees). Further, a later part of the statute, R.C. 5321.04(B) authorizes the tenant to terminate the lease agreement if the landlord violates the statute. So the careful landlord will get the tenant's permission in writing to enter the premises.

Let's look at some cases where the landlord spent a great deal of money fighting over this issue and then lost in the end. In the case of Limage v. Citiscene Apartments, 1992 Ohio app. LEXIS 3055 (June 9, 1992) Franklin Co. app. No. 92AP-190, unreported an agent of the landlord entered into the apartment. The agent's efforts to notify the tenants beforehand consisted of a telephone call on the same date the entry occurred and knocking on the door shortly before entry. The Tenth District Court of Appeals held that this entry occurred in violation of Ohio Revised Code Section 5321.04(A)(8) and reasoned that:

"Since the telephone was unanswered and the knocking elicited no response, the rental agent certainly knew no notice had been received by the tenants. Giving reasonable notice to tenants for purposes of R.C. 5321.04(A)(8) implies that some sort of notice is received." Limage at 4.

In this case, the tenants were allowed to terminate the agreement because of the landlord's unauthorized entry, even though the tenants were not home at the time of the entry. So the landlord got stuck with a lot of legal bills and a piece of vacant property.

Landlords often look upon a request by the tenant to repair something as a carte blanche invitation to enter to fix the problem. This is not the case. In the case of T.K.D. Enterprises v. Zimmerman, 1998 Ohio App. LEXIS 3167 (July 2, 1998) Athens Co. App. No. 97CA44, unreported, the Fourth District Court of Appeals dealt with a case wherein a landlord's agents entered the rented property after the tenant sent a letter listing repairs to be made. The Trial Court held that this was permissible, but the Fourth District Court of Appeals reversed this finding, holding that "Following T.K.D's unauthorized and repetitive entries, Zimmermann had a statutory right to terminate the tenancy on written notice. She gave notice of her termination and vacated the premises within a reasonable time after the improper entries." Zimmerman at 13.

Landlords would also be unwise to rely upon provisions in a lease which allow for unlimited rights of access to the rented property. The Court in Zimmerman also held that:

R.C. 5321.13(A) generally provides no statutory provision of the Landlord/Tenant Act may be waived or modified by the parties' agreement, except in prescribed limited circumstances which do not apply here. Thus, even if the parties' written lease agreement had permitted unannounced entries by the landlord, their written agreement could not supersede Ohio's statutory mandates. Zimmerman at 9 and 10.

In both of the foregoing cases, the landlords spent a great deal of money on attorneys fees at trial, and then a great deal of money on the appeal of each case. In both cases, the landlords lost on appeal, and in both cases they ended up with unrented property.

So the wise landlord is very careful about entry into the rented premises. Even relying upon a tenant's verbal okay is a risky proposition. If the tenant later claims that he gave no such consent, the landlord is in a 50/50 situation when it comes to court. If the court believes the tenant's version of the events, then things are going to get really sticky really fast. It is a good practice to send out a letter to the tenant well before any access to the tenant's property.

It is fine to state in the letter an intention to enter at a certain date and time, and then request that the tenant contact the landlord if that date is going to be a problem, but even this leaves the landlord open to allegations that the tenant did not get the letter. To be completely safe, the landlord should have the tenant sign and return a note confirming that the planned entry is okay.

Tenants who are aware of their rights regarding a landlord's access to the rented premises are growing in number as the Internet provides greater and greater access to information. Landlords should be very careful when making entries into rented property.

6. Use it to give your exact coordinates if your car breaks down - If you are stranded on a highway, you can use the GPS to give the towing company your exact location, so they can reach you faster.

7. Locate your camp- When camping, you can locate your camp without getting lost if you happen to go for a hike or a nearby town.

8. Search and rescue- You can mark the spot if someone happens to fall off the boat or has a similar water emergency. GPS has been used with tremendous success in search and rescue operations.

Agriculture Fighting Climate Change


Our current agricultural practices are a major contributor to climate change. A whopping 14% of all greenhouse gas emissions are attributed to the way we grow, process, distribute and consume food, and an additional 18% are due to deforestation largely driven by the clearing of forests for agricultural land. This problem can only intensify as our population grows. Imagine how many more greenhouse gasses will be pumped into our atmosphere in 2050 when the estimated world population reaches 9.1 billion. Without a drastic change to the way we produce food, we simply won’t survive. ¬¬¬

Traditional agriculture, and even organic agriculture, relies heavily on tilling the soil to prepare the ground for planting. Tilling, however, has a number of undesirable side-effects, such as: soil erosion, loss of organic matter, destruction of living soil microbes, dependence on heavy machinery, loss of soil structure, loss of nutrients and soil compaction. However, there is another negative side-effect of tilling that many people may be unaware of, and that is carbon oxidization. Tilling causes the carbon in the soil to be oxidized which releases it (the carbon) into the atmosphere. This, of course, increases greenhouse gasses and contributes to climate change.

Over the past 30 -40 years there have been people experimenting with no-till agriculture. No-till agriculture uses a range of practices so that tilling is rarely or never used, resulting in the following advantages: improved soil structure, better water and nutrient holding capacity and less use of machinery. However, one of the biggest advantages of no-till agriculture is that the soil can store much more carbon. This means that there will be more carbon in the plants and soil and less in the atmosphere. In other words, agriculture has the potential to become a fighter against climate change. Wouldn’t that be a turnaround?

So far, no-till agriculture has been heavily dependent on herbicides. When I attended agricultural college in the late eighties, no-till agriculture was in its early developmental stages. It was seen as unorthodox and alternative – a little way out. We were taught that paddocks needed to be sprayed out with herbicide first. The dead plants, which were called stubble, were left standing. Then seed was sown through the stubble, using a direct-drilling method. The stubble offered soil protection and increased biomass, which is great. However, the method was completely dependant on chemical herbicides.

The organic industry, which is generally seen as an environmentally positive industry, does things quite differently. They use a combination of green-manure crops and tilling. Green-manure crops, such as oats, millet, clover, and many more, are commonly used and sown into a paddock prior to planting the target species. For example, let’s say our target species is corn. Prior to the corn being planted in spring, a green-manure crop, such as oats, is planted out in autumn and allowed to grow through winter. In spring, the oats are tilled into the soil and the corn is sown. This is an excellent way of building soil biomass and soil nutrients; however, you still have the negative effects of soil tillage, mainly the release of carbon into the atmosphere.

As you can see, both no-till and organic agriculture have their pros and cons. No-till methods store carbon but rely on chemicals. Organic farming uses no chemicals but relies on tilling.

A method that combined the soil protection of no-till farming and the non-toxicity of organic farming would be ideal – agricultural heaven. There are people around the world who are working towards this ideal. These pioneers, referred to as no-till organic farmers, are still working out a few bugs.

With this revolutionary method, a green-manure cover crop is planted out prior to the target crop. However, when the time comes to plant the target species, the green-manure crop is not tilled into the soil, and neither is it killed with herbicide. Rather than being tilled or sprayed, the green-manure crop is killed using a mechanical method called crinking. A large roller with blunt blades set at intervals is rolled over the green-manure crop. The blades crink, but not cut, the stems of the cover crop. It also flattens the cover crop so that it becomes a dense, dead organic matt covering the soil. Then seed is sown using a direct-drilling method through the dead matt. The dead green-manure crop is still attached to the soil via its dying roots. This offers excellent soil protection and the dense matt offers weed suppression and moisture retention. It also increases soil biomass and builds nutrients.

The beauty of this method is the fact that agricultural land can act as a giant carbon sink. This is a complete turnaround as agriculture is presently a major producer of greenhouse gasses. It is believed that no-till farming has the potential to store a staggering 3000 pounds (1360 kilograms) of carbon per acre. No-till organic farming has the potential to become a major fighter against climate change, and provide healthy, chemical-free food at the same time.

With its 8.9-inch screen, the T-Mobile G-Slate is noticeably smaller than both the 10.1-inch Xoom and the 9.8-inch iPad 2. The G-Slate is only slightly heavier than the iPad 2, but, like the Xoom, feels heftier, due to its odd weight distribution.

Construction Mortgage vs. Mechanic�s Lien: Win, Lose or Draw?


Recently, I met with a commercial lender who mentioned a problem with one of his projects. Construction had started, but the developer hadn’t closed the construction loan. Thus the lender’s mortgage hadn’t been recorded, but likely would be soon. He wondered how the delay might affect the priority of his bank’s mortgage lien. Attorneys representing secured lenders in commercial foreclosure cases, or contractors in mechanic’s lien actions, should be conversant with Indiana law in this area.

1910: A Draw. The Indiana Supreme Court’s 1910 decision in Ward v. Yarnelle, 91 N.E.7 (Ind. 1910) is the landmark opinion on this subject. At the time, Indiana’s mechanic’s lien statute “failed to address the lien priority between a [construction mortgage] and the mechanic’s liens of those who [completed] the construction.” In Re Venture, 139 B.R. 890, 895 (N.D. Ind. 1990) (excellent summary of the law). The Court therefore announced the equitable “doctrine of parity” in which a “real estate mortgage executed while a building was in the process of construction was entitled to equal priority with the claims of [contractors that] worked after [recordation] of the mortgage and with full knowledge of its purpose and effect.” Beneficial Finance v. Wegmiller Bender, 402 N.E.2d 41, 47 (Ind. Ct. app. 1980) (no parity because contractor completed its work before lender recorded its mortgage); Brenneman Mechanical v. First Nat. Bank, 495 N.E.2d 233, 242 (Ind. Ct. app. 1986) (parity because contractors had knowledge of loan, which helped pay them).

Whether the contractor had knowledge of the construction mortgage was critical to the Ward analysis. In such instances, the Court felt that lenders and contractors were in a kind of “common enterprise.” Ward, 91 N.E. at 15. Under Ward, if funds derived from the mortgage were used in the construction project and if the contractors had knowledge of the loan when they performed their work, then the mortgage and the mechanic’s lien had equal priority. Conversely, if the loan was not for purposes of construction or if the contractors worked without knowledge of the purpose of the loan, then the mortgage had priority over mechanic’s liens for work performed after recordation of the mortgage. Venture, 139 B.R. at 896

1999: Statutory Amendments. I.C. §32-28-3-5 is the pivotal statute. Subsection (b) provides that a mechanic’s lien is “created” when the lien notice is recorded. But the recorded lien relates back to the date the work began, which could pre-date a mortgage. In 1999, the General Assembly added the language now in subsection (d) that says construction mortgages have priority over mechanic’s liens if the mortgage is recorded before the notice of mechanic’s lien is recorded (not created). My reading is that subsection (d) disposes of Ward’s doctrine of parity, at least as to commercial and industrial projects. (Note that section 5(d)(1)-(3) has carve-outs for certain residential and utility projects.) Accordingly, courts should focus on relative filing dates, and not on work dates or contractor knowledge.

Post-1999: One Case. The meaning of section 5(d) has not been tested on appeal, however, and I.C. §32-28-3-2(b)(2) priority, which favors contractors, may to some extent conflict with section 5(d) priority, which favors lenders. For more on this subtlety, read section 2(b), as well as Provident Bank v. Tri-County Southside, 804 N.E.2d 161, reh’g granted, 806 N.E.2d 802 (Ind. Ct. App. 2004), which gives some insight into the potential inconsistency. (Provident Bank also has an amusing result. The opinion dealt with a contractor’s improvement [installation of a driveway] at a residence long after a purchase money mortgage had been recorded. Believe it or not, the majority held that the contractor’s statutory remedy was to remove and sell the driveway.) Anyway, in the dissenting opinion, Judge Sharpnack toyed with Ward and the new I.C. §32-28-3-5. “In 1999, our legislature amended I.C. §32-28-3-5 and specifically addressed the situation before our supreme court in Ward and again discussed by the bankruptcy court in Venture.” Id. at 168. Judge Sharpnack concluded in dicta that I.C. §32-28-3-5(d) applies “where funds from the loan secured by the mortgage are for the project which gave rise to the mechanic’s lien. In such an instance, the mortgage lien has priority over the mechanic’s liens recorded after the mortgage.” Id. at 169

2007: Lender Wins. At least as to a standard commercial project, therefore, the Ward doctrine of parity seems to be a thing of the past. The lender, in the scenario presented to me, shouldn’t be forced to share equally with any contractors that started construction before the developer closed the deal. Instead, the lender should hold a superior lien, assuming the lender records its mortgage before a contractor records a notice of mechanic’s lien. In other words, if the project goes south, the lender should get paid first. Because it’s been almost 100 years since Ward, perhaps we’re due for another landmark opinion from our Supreme Court. As the law evolves, I’ll provide updates on my blog.

The Next Cool Techno Gadget is Coming - Google Tablet!


How exciting is this next Cool Gadget. I, for one can't wait. When the apple iPad was released I queried whether this gadget would be of any value at all as a useful business tool. The result was an overwhelming no, just a great toy but of not much value for business.

Now I am pleased to advise that finally a real Contender has arrived, yes, it's Google nipping at apple's heels, with its almost ready tablet. This Google tablet hasn't been given a formal name yet.

The device, according to the New York Times, will be "an e-reader that would function like a computer".

Check out these features.

The slate-like computer will run android operating system (OS). (Android is open source software; it can be liberally extended to incorporate new cutting edge technologies as they emerge. android is built on the open Linux Kernel.) Andriod is well developed and already has all the features and capabilities that the Apple's iPad is offering. The tablet will surpass the iPad as it can be an open platform for anyone who can develop software (unlike Apple's closed system). That will certainly excite software developers.

Another feature is that the tablet will also be able run is Google Cloud Computing.

The Google tablet will have all the Google services; Google books, the Google Reader and soon to be released, Google Voice, (Google have recently purchased Skype-rival Gizmo).

All these features will make it a very exciting cool yet functional business tool.

Google though is not the first company to emerge with intentions of overtaking the iPad. Wireless Nokia has announced it too will be releasing a tablet running Windows 7.
