"My debtor has a second home, he brags about this, and I know his buddy has been to the vacation home often. This second house is not findable by me under the debtor's name. How can one drag the buddy of the debtor to court to disclose what he knows about the debtor's property?"
Often, to attempt to get a judgment paid, you want to bring in the debtor for a debtor's examination. Other times, you may need to bring in the spouse, business partner, or employer of your debtor as third parties, to gather information about the debtor that might lead to getting your judgment paid. I am a Judgment Broker, not a attorney, and this article covers what I have done in California for judgments that I owned. The methods are similar in other states. To bring a third party to court, you need to get a court-scheduled hearing. You have to get a court (or lawyer) stamped subpoena, personally served on both the debtor and the third party. You may have to also at the same time, have a consumer notice served on the debtor.
One must pay the court for the hearing, and then pay a process server to serve all parties. You also need to fill in the right court forms (EJ-125), and supply the correct wordings. That is what the rest of this article covers. There are two ways to go, when you fill out the paperwork, to comply with CCP 708.120.
One way is to use only page two of the EJ-125 form. Where it says (2) NOTICE TO JUDGMENT DEBTOR, type or better yet, use a fillable PDF on your computer and print, the reason to bring in the third party in this space, in CAPITAL LETTERS, as it states, because you do not want them to have any reason to try to quash your subpoena.
Write something such as "JANE SMITH IS THE SPOUSE OF THE JUDGMENT DEBTOR AND HAS KNOWLEDGE OF THE WHEREABOUTS OF THE ASSETS AND OTHER NECESSARY INFORMATION REGARDING THE JUDGMENT DEBTOR TO AID IN THE ENFORCEMENT OF THIS JUDGMENT" or "JOHN SMITH IS THE EMPLOYER OF THE JUDGMENT DEBTOR AND HAS FAILED TO COMPLY WITH THE EARNINGS WITHHOLDING ORDER LAWFULLY SERVED UPON THE COMPANY". All you really need is something stating why you need to ask the third party questions under oath about the judgment debtor.
If the reasons to bring in the third-party need further explanation, you will need to file a separate affidavit, declaring who this person is, their relationship to the judgment debtor, and whether they 1) Are indebted $250 or more to the judgment debtor, or 2) Likely have knowledge about the judgment debtor's assets.
On the EJ-125, on the back, you describe the judgment debtor's property under control of the witness, so you can effectively identify and lien the property, because a correctly served subpoena creates a silent one-year lien on any identified property.
On a separate affidavit, on regular pleading paper, using a standard format, write "Affidavit for 3rd Party Judgment Debtor Examination." For example, AFFIDAVIT OF YOURNAME, IN SUPPORT OF THIRD PARTY EXAMINATION OF MR. DEADBEAT DEBTOR. (or) AFFIDAVIT OF YOURNAME, ASSIGNEE OF RECORD, IN SUPPORT OF THIRD PARTY EXAMINATION OF MR. DEADBEAT DEBTOR. In the body of your affidavit, you write something based on your "belief and information":
I, the undersigned, declare as follows:
1. I am the (judgment creditor/assignee of record) in this case. I am over 18 years of age. I have personal knowledge of the facts herein, except as to those facts stated to be known upon information and belief, and as to those facts, I believe them to be true. If called upon to testify, I could and would competently testify thereto.
2. Judgment for the plaintiff in the above-entitled matter was entered on May 1, 2010 in the total amount of $XX,XXX.00 awarded against MR. DEADBEAT DEBTOR. The total amount plus interest and costs remain due.
3. I wish to examine MORTIMER SNERD, third party who is the (spouse, employer, etc.) of the judgment debtor.
4. I am informed and believe that MORTIMER SNERD has in his/her possession property of the judgment debtor, and that MORTIMER SNERD is indebted to the debtors in an amount exceeding $250. (Or that MORTIMER SNERD has knowledge of judgment debtor's assets - based on your information and belief.)
I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.
Then, you should list your Points and Authorities to back up your request. What I have done (only in California) to bring in 3rd parties to court when enforcing judgments I own, is to include points and authorities along with my declaration for a third party examination try to find debtor's assets. Here are points and authorities I haves used, on the second page of my affidavit, and also placed in the third party request itself:
POINTS AND AUTHORITIES IN SUPPORT OF ISSUANCE OF appLICATION AND ORDER FOR appEARANCE AND EXAMINATION OF THIRD PERSON
CCP 708.120. (a) Upon ex parte application by a judgment creditor who has a money judgment and proof by the judgment creditor by affidavit or otherwise to the satisfaction of the proper court that a third person has the possession or control of property in which the judgment debtor has an interest or is indebted to the judgment debtor in an amount exceeding two hundred fifty dollars ($250), the court shall make an order directing the third person to appear before the court, or before a referee appointed by the court, at a time and place specified in the order, to answer concerning such property or debt. The affidavit in support of the judgment creditor's application may be based on the affiant's information and belief.
CCP 708.130(a) provides that witnesses may be required to appear and testify before the court or referee in an examination proceeding under this article in the same manner as upon the trial of an issue. This includes the examination of any third person who has, or may have, knowledge of the judgment debtor's assets and liabilities. This includes the spouse of the debtor who, it can be reasonably calculated, possesses special knowledge regarding the income and assets of the debtor.
This understanding of the meaning of CCP 708.130 is corroborated by case law. While there is no case specifically dealing with third parties, the language of case law leaves little doubt that the scope of a debtor's examination is not to be unnecessarily narrowed. In the case of Kyne v. Eustice the court found:
The object of the proceeding is to compel the judgment debtor to give information concerning his property; and such judgment-debtor examination is intended to be summary and factual, according the widest scope for inquiry concerning the property and business affairs of the judgment debtor. (Coleman v. Galvin, 78 Cal.App.2d 313, 318 177 P.2d 606; McCullough v. Clark, 41 Cal. 298, 302.)
The purpose of such supplementary proceedings are to discover and reach assets of a judgment debtor so as to apply them to the satisfaction of the judgment. (Smith v. Smith, 51 Cal.App.2d 29, 31-32 124 P.2d 117; Coleman v. Galvin, supra,; In re Finn, 155 Cal.App.2d 705, 709 318 P.2d 816.) page 633
Accordingly, a third person or corporation alleged to have property of a judgment debtor or to be indebted to him may be examined concerning the same (CCP 717 now Â§708.120; Coleman v. Galvin, supra), and such proceedings may be properly used to obtain the possession of third-party debts after such examination. (Thomas v. Thomas, 192 Cal.App.2d 771,778 13 Cal.Rptr.872; Hathaway v. Brady, 26 Cal. 581, 589.) Kyne v. Eustice, (1963) 215 CA2d 627, 632, 30 CR 391
Further, in Young v. Keele, and cited in numerous subsequent cases, the courts asserted the wide scope of inquiry permissible in judgment debtor's examination, to the extent that its purpose is "to leave no stone unturned in the search for assets which might be used to satisfy the judgment." Young v. Keele (1987) 188 Cal.App.3d 1090, 1093 233 Cal.Rptr. 850; see also Troy v. Superior Court (1986) 186 Cal.App.3d 1006, 1014 231 Cal.Rptr. 108
Given the above, you, as the Assignee, requests that the court order the issuance of an Application and Order for Appearance and Examination directed to the above Third Party.
A Sheriff or Process Server will serve your papers, along with a copy of your Points and Authorities, so that it is clear that the witness is being served in the capacity as a person with knowledge of the debtor's assets.

Has your lending institution failed to maintain an original or copy of an executed promissory note? Similar to the case discussed in my February 7, 2009 post “No Signatures, No Promissory Notes, No Problem,” the Indiana Court of appeals in Baldwin v. Tippecanoe Land & Cattle, 2009 Ind. app. LEXIS 1491 (Ind. Ct. App. 2009) upheld a summary judgment for the plaintiff lender even though the lender could not produce the signed promissory note.
Procedural history. Lender filed a claim to foreclose its second mortgage and attached to the complaint a promissory note that was not signed. (The mortgage did, however, appear to contain the borrower’s signature, and the unsigned note referred specifically to the accompanying mortgage.) In his response to the lender’s claim, the borrower entered a “general denial” pursuant to Indiana Trial Rule 8(B). The lender later filed a motion for summary judgment that the trial court granted.
The borrower’s contentions. The borrower argued that the mortgage was unenforceable because the note was not signed by him.
The lender’s contentions. The lender’s theory to get around the absence of the signature rested upon Ind. T. R. 9.2(B), which states: “When a pleading is founded on a written instrument and the instrument or a copy thereof is included in or filed with the pleading, execution of such instrument . . . shall be deemed to be established . . . . unless execution be denied under oath in the responsive pleading or by an affidavit filed therewith.” The lender’s point was that the execution of the note was deemed to be established pursuant to this trial rule.
Rule 8(B) versus 9.2(B). The Court of Appeals analyzed the technical requirements of Trial Rules 8(B) and 9.2(B), as well as Rule 11(A) dealing with signatures on court filings. Those rules, collectively, “mean that the attorney’s signature on a general denial [per Rule 8(B)] rejects the assertions in the claim, but does not constitute an oath by which the pleader denies the execution of an instrument attached to a claim [per 9.2(B)].” Because the borrower failed to deny, under oath, the execution of the subject note, the Court affirmed the summary judgment granted in favor of the lender: “As [lender] attached the Note and Second Mortgage to its cross-claim, execution of both would be deemed to be established, by operation of Trial Rule 9.2(B), unless [borrower] denied under oath that they were executed. [Borrower], himself an attorney, filed a general denial. He signed it as “respectfully submitted.” He omitted to include a statement that his general denial was truthful and made under penalty for perjury. Thus, [borrower] failed to deny under oath the execution of the Note. We therefore conclude that execution of the Note was deemed to be established . . ..
As was the case with the Bonilla opinion, which was the subject of my February 7, 2009 post, Indiana law seemingly allowed the lender in Baldwin to dodge a bullet in order to obtain a pre-trial judgment in its favor.

Released within a month of each other, the Blackberry 9000, better known as the Blackberry Bold (May 2008) and the Nokia E71 (June 2008) are obvious rival smartphones from these perennial rival smartphone makers as they look, feel, and function very much alike.

You can view Microsoft Word, Excel, and PowerPoint documents on both devices, but you can only edit them on the Blackberry.
The battery on the Bold gives up to 5 hours of talk time and 310 hours of standby time. The battery on the Nokia gives up to 10 1/2 hours of talk time in 2G or 4 1/2 hours in 3G, and 410 hours of standby time in 2G or 480 hours in 3G.
Deciding between these two devices is a tough call, and may come down to extraneous features such as the availability of preferred 3rd party apps. Or you may just prefer the Blackberry operating system to Symbian. You may also lean towards the Blackberry Bold if you want to be able to edit Microsoft Office docs, though you might lean towards the Nokia E71 if you'd rather take crisper digital photos. Really these two devices are quite comparable.

We've integrated a number of unique features, such as using the mobile phone's built-in gyro to look around inside the car. If you turn the phone, the image viewed moves too, creating the impression that you're actually sitting inside the car."

How Secure Is Your Mobile Device?
Do you own a keychain USB jump-drive, a PDA, or an all-in-one mobile communications device? If you do, what type of information do you store on it? Many people would say there is nothing important stored on their mobile device. Many of our customers initially state there is nothing on the computer network that hackers would want or a virus could irreparably damage.
I want to start out this article with a couple real-life stories about why it is so important to make sure your mobile devices are secure.
Panic Over Lost Jump-Drive
About a year ago, a business acquaintance contacted me in a panic. apparently, he was onsite performing an internal security audit for a rather large company, and had lost or misplaced his keychain USB Jump-Drive. At first, I was not sure of why he was in such a panic. That is, until he told me the drive contained approximately 300Mb of security information minded from a previous security audit he performed. He was scared out of his wits that this information would fall into the wrong hands, not to mention the hands of his new client. What would his new client think if they found he was walking around with this information on a device that anyone4 could gain access too. Would he do the same thing with their information? Lucky, after retracing his steps in the building, he found on the floor of the men's room. He apparently pulled out his keys and the jump-drive came off the keychain. He no longer carries his jump-drive around with him.
Confidential Client Information Lost In Snow Storm
On another occasion, someone quite close to me, dropped his Toshiba PDA somewhere between his car and food store. Not to big of a deal, except for the fact that there was about one foot of snow on the ground. He spent the next three hours drudging through the snow looking for the PDA. Besides the fact that it was not an inexpensive PDA, it contained his entire client list, personal online accounts with user-id's and passwords, and several other categories of highly confidential information.
In both the cases above, neither of these people had given much thought to the loss of these devices. Why should they? They were both experienced professionals in the information technology business and very careful and conscious about keeping information secure. The problem is, their both human. And humans make mistakes an erroneous judgment calls.
How To Secure Mobile Devices
Because there a so many types of mobile storage and communications devices, there are many ways to secure them. So, I will stick to what I do to secure the above mentioned devices since I happen to use both types.
I use 1GB USB 2.0 Jump Drive to store and transfer many types of information. Sometimes, this includes confidential information. For instance, when I travel, I have a copy of my account database on the device. However, the device file-system itself is heavily encrypted, and the database stored on the encrypted file-system, is encrypted. If I happen to misplace this device, I am more than confident (at least at this point time) that the data is protected and not easily accessible. Now, nothing substitutes for not carrying around this type of information to begin with, but it is safer than carrying around a printout of the excel spreadsheet you keep you passwords in.
As far mobile communications. I don't know what I would do without my mobile phone. It has replaced my PDA, has unlimited internet access, a VPN client so I can retrieve my mail without having to use a separate service (more $), a 1GB storage card, camera and so on. The primary thing that this device stores that is confidential, is my contact list. There are other items I don't want just anyone to have access too as well. Not to mention using my phone (more $). So, the storage card is encrypted, and that is where my important data is kept. The device itself is password protected with and eight character key that meets or exceeds standard complexity rules. And, the mail client itself requires authentication in order to use it.
If you use mobile devices on a regular basis, I suggest you sit down and think about exactly what you store on them. It is sometimes easy to overlook these things or under estimate exactly how private or confidential certain information is or should be. Make sure you take reasonable steps to keep the information stored on mobile devices secure and private. It is definitely a balancing act between security and easy of use.
And, what ever you do, don't leave your mobile device in the men's room.

When I became a family law attorney/mediator after a dozen years as a therapist, one of the biggest surprises was the extent of lying in Family Court: lies about income, assets and even complete fabrications of child abuse and domestic violence. Why would people lie so much, I wondered? How did they get away with it? The following is my psychosocial analysis of what I believe has become an epidemic:
Men lie: It was a sad phone call from a relatively new client. He informed me his father had just died. He had quit his job and was moving back east to wrap up his father's affairs. He asked me to tell his wife's attorney that he would not be able to pay child support for their three young children for a long time. (There was no support order yet.)
The next day, his wife's attorney called me back and described how upset his wife was to learn of her father-in-law's death. So upset, that she had called his father -- and had a nice chat!
Women lie: A mother involved in a custody battle told the court in dramatic detail about physical abuse at the hands of her husband. She even submitted reports of visits to doctors and emergency rooms for her bruises.
However, a court-ordered psychological evaluation determined the allegations were false. The court agreed and awarded custody to the father. A few weeks later the mother picked up the children from school and disappeared for a year. She was caught, sent to jail for parental kidnapping, and the children returned to the father.
Societal Increase in Lying. Surveys show that lying has increased over the past decade. In 1999 alone: the President was tried in Congress for perjury; a popular journalist in Boston was publicly fired for fabricating heart-rending stories; and a scientist was exposed for falsifying research on a high-profile safety issue.
We have become a society of individuals. Personal gain is more important than community values. In this mobile "information age," we rely on strangers and are easily fooled. In business, politics, and the movies, winning is everything. Successful manipulation and deceit are admired. In court, lying is often rewarded and rarely punished.
No Penalty for Perjury . Divorce Courts rely heavily on "he said, she said" declarations, signed "under penalty of perjury." However, a computer search of family law cases published by the appellate courts shows only one appellate case in California involving a penalty for perjury: People v. Berry (1991) 230 Cal. App. 3d 1449. The penalty? Probation.
Perjury is a criminal offense, punishable by fine or jail time, but it must be prosecuted by the District Attorney--who does not have the time. Family Court judges have the ability to sanction (fine) parties, but no time to truly determine that one party is lying. Instead, they may assume both parties are lying or just weigh their credibility. With no specific consequence, the risks of lying are low.
Personality Disorders and Patterns of Lying. Family Courts see everything: from small deceptions about income to the complete fabrication of abuse. The increase in lying seems to correspond with the rising number of people with personality disorders. They often have internal distress, less empathy for others, a highly adversarial world view, an intense and manipulative nature, and a sense of victimization which they use to justify harming others. Studies show they have identifiable and predictable patterns of lying:
A party with a Borderline Personality Disorder may lie out of anger or even self-deception in an effort to maintain a bond with their child or spouse--or to retaliate for abandonment. Battles over custody and visitation are common.
One with a Narcissistic Personality Disorder may lie to boost themselves or to put other people down. They enjoy manipulating the truth and other people's lives. They may experience excitement and a sense of power by successfully fooling the court and dominating the other party. An Antisocial Personality Disorder is characterized by deception, manipulation, and disrespect for authority. Commonly known as "con artists," they are skilled at breaking the rules. They fabricate detailed events and use the courts to get revenge or money. Their lack of empathy makes them constant liars -- and often violent.
A Histrionic Personality Disorder is often highly dramatic and demanding, with superficial charm and seductiveness. They are skilled at lying and self-deception. Fabrication is also common.
Detecting Deception. Few people can visually detect deception. Research on judges, federal polygraphers, psychiatrists and college students showed that all were no better than chance using a standardized videotape test. Only Secret Service Agents were better than average at distinguishing truth and lies.
Some studies show that the more confident a person is, the less effective they are at lie detection. Studies of police investigators and customs inspectors found that those with more experience were less accurate than novices.
Ineffectiveness of Non-Verbal Cues. Many people believe they can determine whether someone is lying by observing non-verbal behavior, such as: touching their face, blinking their eyes, suddenly itchy nose, neck-scratching.
These behaviors indicate anxiety, which most people experience when then lie. However, most people display anxiety when they are under any pressure, such as being challenged about their honesty. Therefore, these symptoms are unreliable.
Studies show that the only way non-verbal cues may be truly helpful is to observe a person over time. Their changes in non-verbal behavior may be a more accurate indicator of lying. An additional problem is that those with antisocial personalities actually become less anxious when they lie, and therefore do not exhibit behavioral cues and do not register anxious symptoms on lie detector tests.
Effectiveness of Examining Records. Studies have shown that examining documents for contradictions has been more reliable than focusing on non-verbal cues. In fact, they have found that evaluators were best at lie detection when they were blind to nonverbal cues. Those who just read transcripts were the most accurate.
What Can Be Done? The adversarial process naturally encourages lying: winning is the goal, liars get equal time, and the most skillful adversary wins -- regardless of the truth. To overcome this inherent problem, we need:
More use of mediation: Mediation and negotiation focus on problem-solving for the future. Lying about the past has little relevance. The parties know the lies and do not tolerate them.
More judicial time: Most divorce court decisions are made in 10-20 minute hearings. Judges must determine the custody and visitation schedule, the amounts of child support and spousal support, and often whether restraining orders are appropriate. There is little time to analyze each declaration to determine who is lying. Judicial lectures alone have little impact or the opposite effect on personality disorders. More judges with more time could reduce lying from the start.
More attorney research: Attorneys often advocate for their clients' statements without investigation. They often assume they will never know who is telling the truth. Instead, they should learn about personality disorders and patterns of lying, more carefully question their clients, and more aggressively seek corroborating evidence.
More therapist awareness: Therapists are trained to form impressions based on interpersonal observations rather than external evidence. They form strong bonds and believe their clients. They can provide the court with observations of their own client's behavior, but should not reach conclusions based on hearing one side. They need to be more wary of manipulation in court cases.
More consequences: It is an established dynamic of human behavior that rules made, but not enforced, are increasingly broken. Lying in court is already illegal. So long as there is no penalty for perjury, lying will increase. Family Court sanctions (fines) should be used for lying.
More training: Court-related professionals need to realize that you cannot tell who is lying by simple observation. Yet one can learn personality dynamics which help indicate who might be lying, patterns of lying and where to look for evidence.

Loving parents faced with a dispute over child custody have occasionally used tactics that the Courts did not favor. While it is impossible to describe all the things that should be avoided when seeking to secure time with your child(ren), a few examples of what not to do may be helpful. A good divorce attorney will counsel their clients that they should focus every argument and tactic on the best interest of the child(ren). Sometimes parents forget this basic point, and their over the top tactics have not worked out very well.
In Keith R. v. Superior Court (2009) 174 Cal.App.4th 1047, the mother alleged Domestic Violence, got a CLETS Order, and then, while the father still was working on completing his 52 week batterer’s intervention program, filed her move away motion so she could take the child with her to Arizona. Her timing was excellent, from a kick your opponent when he is down perspective, since the father could not complete the 52 week program before the move away hearing, and therefore, she argued under the custody language in the CLETS Order which could not be changed until after the 52 week program was completed, she had sole custody and father could not show a change in circumstances to allow him to dispute the sole custody, and therefore he could not dispute the move away. Unfortunately for mother, the appellate Court ruled that a Domestic Violence Order is not a final custody determination. Going back to basics, the appellate Court wanted an actual weighing of the best interests of the minor child before the move away.
In In re Marriage of Nurie (2009) 176 Cal.App.4th 478 the mother took the five-month old child to Pakistan, with the father, on the pretense that she intended to return in a few weeks. She stayed in Pakistan. Father filed a divorce in California when he found out he had been tricked, and was granted temporary custody of the child. After mother was served with the California Order, she then filed in Pakistan. The Pakistani Court first rejected the mother’s request, but unfazed, she re-tricked the father into signing a compromise agreement, which agreement was based on the intent that she return to California with the child. In predictable “fool me once shame on you, fool me twice shame on me” fashion, the mother reneged on the compromise agreement and stayed in Pakistan. After much legal wrangling in Pakistan, the father and three armed accomplices allegedly kidnapped the child outside the mother’s lawyer’s office in Karachi, and returned him to California. The Court declined to determine the truth of the kidnapping allegation, and stated that it could not ignore that the mother had willfully disobeyed the California Court Order grating father temporary custody.
In Robert J. v. Catherine D. (2009) 171 Cal.App.4th 1500 the mother accused the father of child abuse and neglect. Almost two years after the accusation, the Court entered a Judgment granting the father full legal custody and exonerating him of the accusations. The father sought sanctions under Family Code Â§3027.1. He sought sanctions of more than $750,000 against the mother and her attorney. The statute allows sanctions against both the other party and their counsel if the allegation of abuse or neglect was false, was made in a child custody proceeding, and the person or persons making the allegation knew it was false when they made it.
A good divorce attorney will counsel you on how to present your side of a child custody dispute without making the Court angry or being sanctioned. As shown in the three examples above, procedural trickery with a CLETS, ignoring a valid custody order, and falsely accusing the other parent of child abuse were all failed tactics.
